My wife and I are the alleged gun toting couple at the courthouse on july 23, 2008 .
The complete story is my x-wife took my child for summer visitation and then refused my rights of visitation , as per the divorce degree , I am the custodial parent at this time . While i am trying to file contempt of court and custodial interferance on her she files a motion to modify and a restraining order on me , I go to legal aid they state conflict of interest and will not help me.
I go to the courthouse and get copies of records on file , when i compare them to the ones i have they are altered ,I point this out to the D.A. no interest , Abilene police , no interest , the 326th district court no answer , i go to child protective services and they inform me that my x-wife had filed mentaly abusive charges on me and a case worker was probly at my house then, i tell a Ms. Reeves my story and go home and sure enough a note to contact the Coleman child protective service is on our door so we call and they come over and interview my wife and i and then say we have to submit to a drug test , we agree , and even though my x-wife claimed 4 times she was bringing Sadie to abilene c.p.s. she never did the c.p.s. ask her to be drug tested and she refused , as the hearing time draws near , i call the child protective services and they will not return my calls. I go to my daughters doctors office and request their complete files what i see horrifies me and i am appalled that the doctors did not flag this woman ! i go to the abilene c.p.s. with this info. and they refuse to look at it , I request my files were i had request investigations and the very rude man told me my allegations had been purged ! Then he told me to fill out a form and maybe if he felt like it i could see my file in two weeks . I said why if i've been purged you won't have anything and wadded up the paper , he said to call the police to have my wife and i removed and i said don't bother we are leaving !
I tell about my x-wifes now husband and show the records to my attorney , they were so absurd i doubt she really believed me since to date no-one has during her preperation for the hearing her secretary goes oh my GOD , a friend of mine used to be married to this guy and everything earl is saying is true and more !
So we drive to abilene on the 23 of July for the hearing , my lawyer shows the medical records to the judge and voices my concern for my daughter her lawyer comes out and talks with my x-wife her husband gets up and goes downstairs and tells a bailiff that my wife has a gun in her purse and another one in the car and that i am a convicted felon , he forgets to mention that i was 17 and at 53 other than two speeding tickets have not been in any trouble since . My wife ,thinking it is going to be awhile decides to go to my heart doctors office to make an appointment and give them the insurance papers they need to fill out. The hearing is over and i am going to the resturant across from the courthouse where we agreed to meet to eat lunch before the drive home i hear my name and see a Deputy and i say sir i am here , i am earl mackey. He keeps talking on the phone and i realize he is not calling my name he is checking my name so i again say sir i am earl mackey he comes out of the booth about 5 officers surround me and he (very politely)tells me that they had just been told that my wife had a gun in her purse they had her on video and that when she saw them looking in our car she waited at a side exit and left when they came back inside , i totally freaked and said GOD no , sir my wife did not bring a gun into the courthouse he then ask me if their was a gun in the car and i said i did not think so but if there was it would be in the trunk with our river gear . he told me i could not leave the courthouse and he wanted to know where my wife had gone , i told him and after a bit i remembered that when we parked the car that morning my wife ask if she had to show i.d. in the courtroom ? i said i'm not sure and she said then i am not carrying my purse it does not match my dress and blouse , i tell this to the deputy and ask him to please review the video and they would see that my wife did not have a purse on her ! He said thats right i saw her purse in the car when we were looking in it . i walked around and looked at the artwork and the Deputy informed me i could leave if i wanted to but if a gun was in the car i would be arrested the second i got in the car so when my wife pulled up i ask her was her gun in the car and she said maybe but it is in the trunk if it is ,i told her to go find out for sure and if it was to pawn it to keep me from going to jail . What i want to know is why nothing is being done to this man for making a false accusation that could have very well ended in a horrible scene because like all red-blooded Texans you grab my wife with me there no matter what i am going to grab you and the Deputies being told we had guns it could have been bad for everyone there all the people there and my daughter who was there also.
There thats my side of the story and my name IS Earl , I would like to praise and thank the Deputies in the courthouse that day for their calm and professional manor in the defusing of this very serious matter !
