Sentencing For Accused Murderer Delayed

According to colemannews.com, the sentencing phase of the murder trial of Patrick Pence was originally scheduled for Wednesday, May 13, 2009. Judge Weeks has postponed the sentencing hearing to next Wednesday, May 20, 2009. Pence was tried for the murder of Joshua Todd Weaver earlier this year. The trial began on May 6th and a plea agreement was reached on May 9th. Pence pled guilty to a lesser offense of Aggravated Assault by causing bodily injury. According to Judge John Weeks, this represents a 2nd degree felony, punishable by two to 20 years in prison. However, Pence did apply for probation and is eligible for probation, Weeks said. Pence waived the right for a jury to sentence him so sentencing will be done by Judge Weeks in approximately 30 days. Pence will remain free until sentencing.
