Police are investigating a serious crash that happened near Kirby Dam Monday evening.
Neither of the two people in the vehicle were wearing seatbelts when their truck rolled over shortly before 6 p.m.
"As it pertains to motor vehicle laws on that roadway it does become very gray," said Assistant Police Chief Doug Wren.
However, although standard traffic laws may not apply, drivers are still held accountable for their actions.
"As it relates to reasonableness and recklessness, that burden of proof is no different," Wren said. Due to the circumstances of the crash, whether or not charges will be filed will be left up to the DA.
The 16-year-old driver sustained minor injuries, but the 44-year-old passenger is still listed in critical condition at Hendrick.
