Jonathan McCain is charged with aggravated assault and a jury will have to decide this week if the HIV virus was used as a deadly weapon.
McCain was accused in 2009 of knowingly spreading the virus to a woman in Abilene and therefore causing serious bodily injury by having unprotected sex with her.
Opening statements will begin Tuesday.
*This story has been corrected from a previous version that said McCain was a Dyess airman.
