Ruben Soliz was taken to jail from the courthouse but when he arrived he was informed he could just go home.
He said he knew it was a mistake, and told the jailer that it was a mistake.
But he thought something may have changed without him knowing.
When he got home he called his probation office and that's where the mistake was caught.
Soliz was recaptured the next day and went back to jail cooperatively.
The sheriff's department says a mistake was made and Soliz was let go during a time when several inmates at the jail were being released.
Soliz was sentenced to five years prison time on a motion to revoke his probation on burglary of a habitation charges.
