Report Submitted Following Airman Hearing in Relation to Kalpheke Case

On Nov. 30, 2012, Lt. Col. Sandra Kent, the judge advocate who presided as the investigating officer for the Article 32 hearing of Senior Airman Christopher Perez, 7th Security Forces Squadron, provided an original copy of her Investigating Officer's Report to the 7th Bomb Wing staff judge advocate's office.

Following the hearing held at Dyess on Nov. 19, Kent was instructed to draft a report containing a recommendation about the disposition of the allegations against Perez, who was charged with failure to report child abuse or neglect under Article 92 of the Uniform Code of Military Justice (UCMJ), as well as adultery and child endangerment under Article 134 of the UCMJ, in relation to the case of Tiffany Klapheke. Additionally, in an allegation which is not related to the Klapheke case, Perez was charged with wrongful sexual contact of an adult female under Article 120 of the UCMJ.

A copy of Kent's report will be provided to Perez and his defense counsel. Col. Glen VanHerck, 7th Bomb Wing commander, will also receive a copy. After reviewing the report, VanHerck will decide whether or not to proceed with each of the allegations and determine dispositions. The decision process typically takes 7-10 days, and possible dispositions of the charges range from dismissal to a general court-martial.
