Charles Camp was arrested when a search warrant was served at the Abilene Gold Exchange last December by the Abilene Police Department.
The other co-owner, Marcus Cass, pulled a gun and police say he did not comply with verbal commands, and he was shot and killed by an Abilene officer.
Camp was taken into custody and charged with failing to document transactions at his business for tax records, as well as felon in possession of a fire arm.
Camp's attorney, Randy Wilson, says they have until the 14 of this month to decide if they are going to plea out of court.
