Charges Filed in Anna Nicole's Death

Attorney Howard K. Stern had been the constant companion of the former model and wealthy widow Anna Nicole Smith until her death in Florida two years ago of what was determined to be an accidental overdose.

Now Stern and two southland doctors, Sandeep Kapoor, and psychiatrist Kristine Eroshevich, are accused in this 11-count criminal complaint of conspiring to violate drug laws in providing narcotics and other addictive drugs to Anna Nicole Smith.

The prescriptions at time made out under other names, including Michelle Chase and Howard K. Stern himself. Tonight, Attorney General Jerry Brown announced the filing.

California Attorney General Jerry Brown said "well the scenario is using false names. And getting prescriptions for thousands of pills without medical necessity and making them available to Anna Nicole Smith who was obviously addicted. All of that violates the law of California."

Evidence was gathered during the execution of warrants at the doctors offices and other locations as far back as October of 2007.

The complaint alleges drugs given to her included xanax, opiates, hydromorphone, and lorazepam.

Attorneys for the accused were notified of the filing so they could make arrangements to surrender at locations brown declined to reveal.

Mr. Brown said "I'm not at liberty to discuss that."

We learned later that both Stern and Kapoor went to the Whittier police station to surrender. Booking did not take long and both quickly posted the $20,000 bail and were released to await arraignment.

Doctor Eroshevich is expected to surrender in the next few days. Her attorney told us that she was attempting to help Smith get through a stressful time in her life after the death of her son and that the false names were used not to circumvent the law, but to try to preserve Smith's privacy. The arraignment date is yet to be set.
