UPDATE: Randall Philen Released from Prison

Brown County Sheriff and district attorney's office confirm Randall Philen was brought back to Brownwood today from state prison in Huntsville. 

He is now out of jail on a personal recognizance bond.

Philen was convicted in November of murdering his brother and sentenced to life in prison, however new evidence has emerged leading to the arrest of three men in connection with the murder.

The mother of the Brownwood man convicted of killing his brother is speaking out about new revelations in the case that may prove his innocence.

Randall Philen was convicted of murder in November, although he maintained he was tied up and watched as his brother was murdered by home invaders.

"Everything he said was absolutely the truth," says Linda Philen, Randall's mother.

The Brown County District Attorney's office filed a motion Tuesday morning for a new trial, and Philen's mother says her son is expected back today or tomorrow. He'll be taken to the Brownwood jail and then have the opportunity to bond out, according to Ms. Philen.

She said they're all a little scared knowing additional suspects are still on the loose.

Ms. Philen described Randall as being traumatized after watching as his brother was killed, and voiced her displeasure with the district attorney's office.

"I think that someone is trying to cover their tracks," Ms. Philen said.

She said one juror has already called the family and requested to meet with her son, hoping to apologize to him.
