Emmett and Patricia Miller were passengers on the bus last November when it went out of control south of Ballinger.

ACU student Anabel Reid died in the crash. Several others were injured.

According to the lawsuit, the Eldorado Company which built the bus failed to provide reasonable occupant containment and protection in rollover crashes.

The lawsuit was filed in 350th State District Court in Abilene.

No trial date has been set.
