APD: Man Leaves After Being Warned, Comes Back, Goes to Jail

Yesterday at about 6:00 p.m., officers were dispatched to criminal trespass call at a residential apartment complex in the 2000 block of South Clack Street. APD was notified that a known male was seen on the property and that the person was recently warned not to return to the property. Officer Brandon Scott arrived and observed several subjects at the incident scene. He began his investigation by contacting a male subject. The subject became uncooperative with him and Officer Scott attempted to detain the subject. When Officer Scott attempted to detain the subject, the subject physically resisted and then pulled out a bag from his pocket that he discarded. The subject then ran away. Officer Scott gave chase and caught up to the man and placed him under arrest. The subject lied about his identity. Preliminary investigation revealed that the discarded bag contained pills that were controlled substances. Upon searching the subject, a small quantity of marijuana was located in the his pocket. Additionally, the man showed to have some municipal warrants. The male subject was arrested on the following charges: tampering with evidence, resisting arrest, evading arrest, failure to identify, possession of a controlled substance (Alprazolam), and possession of marijuana.

While Officer Scott was investigating the above incident, Officer Brian Poynor was dispatched to assist him. Officer Poynor contacted one of the male subjects at the incident location. The subject was warned to leave the property after conferring with a representative of the apartment complex. Officer Poynor observed what he believed was compliance to the order and he saw the subject get into a vehicle and drive away. After officers had finished investigating the original call, Officer Poynor was leaving the property when he observed the same male subject, that had been warned to leave, standing outside his vehicle a few buildings away. He was again told to leave the premises as previously warned to do so. The male subject refused to leave and was arrested for criminal trespass.

At about 12:30 this morning, Sgt. Jason Haak contacted a motorist in the 2100 block of Sayles Boulevard for several traffic violations. He contacted a male driver and smelled the odor of alcohol coming from him. Sgt. Haak's investigation revealed this subject showed indicators of intoxication. Officer Mary Guitar assisted in the investigation and the subject was given standard field sobriety tests which he failed. The subject was arrested and taken to county jail where the man provided breath samples. Breath samples taken revealed the driver's BAC to be 0.221 and 0.228. The man was arrested for driving while intoxicated (DWI).
