APD: Man Arrested for Felony DWI with Kids in Car

Just before 11:30 last night, Officer Chris Jennings was informed by a fellow officer who was directing traffic near the Taylor County Expo Center that he was nearly struck by a vehicle being driven by a male subject. The officer directing traffic contacted the driver of the vehicle and smelled the odor of alcohol coming from the driver. Officer Jennings arrived in the 1800 block of E. S. 11th Street and assisted in the investigation. His investigation revealed that the driver of the vehicle had the strong odor of alcohol coming from his person and the driver showed signs of intoxication. His investigation also revealed that the vehicle was occupied with two other adults and two small children whose ages were 7 years, and the other 8 months. The driver was given field sobriety tests which he failed. The driver was arrested and taken to jail where he provided breath samples. Breath samples taken revealed the driver's BAC to be 0.094 and 0.092. Because the vehicle was occupied by children younger than age 15 at the time of the offense, the driver was charged with an enhanced charge of state jail felony driving while intoxicated.
