Updated: August 3, 2012
On Thursday at approximately 7:00 p.m., a 2012 Kenworth tractor trailer driven by Vergil Dewayne Birmingham from Hugo, Oklahoma was hauling 30 head of cattle for Ellison Carter Trucking Company. Birmingham was heading north on Frio Street when he approached a railroad crossing.

Birmingham failed to yield to an oncoming train that was traveling west bound. The tractor trailer was struck by a Burlington Northern Santa Fe Railway train that was hauling 50 cars. The impact left the cattle and trailer at the impact site.

The tractor was pushed approximately 600 yards west of the impact site until coming to a stop near Vale Street.

The driver of the tractor trailer was removed from the tractor by two bystanders before fire broke out. Vergil Dewayne Birmingham was pronounced dead by Dr. John Horner at Coleman County Medical Center at 7:35 p.m.

The Coleman Police Department was assisted in this investigation by the Texas Department of Public Safety, Coleman County Sheriff's Department, Coleman Fire Department, Coleman EMS, and several other volunteer fire departments.
