Suspect in custody in Abilene shooting

A 12-year-old boy is still hanging on to life after being shot while in the back seat of an SUV just about 24 hours ago. The vehicle was leaving the scene of an altercation, and was shot at, from a home in the 5300 block of North 9th. The 12-year-old was hit in the head and his  8-year-old brother, also in the back seat, was grazed by a bullet.

Police have a suspect in custody. 21-year-old Christopher Mack was arrested at about five this morning. He is charged with two counts of first degree felony injury to a child, but one of those charges could be changed pending the condition of the 12-year-old.

When this investigation started police said they were going to work until there was nothing else to do. Even though there is a suspect in custody, there is still a lot of work to be done.

Police say Mack shot twice at the SUV. Sergeant Lynn Beard says a 911 call was made from the vehicle as the two adults inside were taking the children to Hendrick Hospital. Police believe they have recovered the gun used in the shooting at the scene. They also talked to several witnesses that led them to Mack. Before Mack was arrested, the SWAT team went back to the house and searched it after police obtained a search warrant. They are not say what they found inside. They are also not saying if the adults in the SUV with the kids will be facing any charges or what the children were doing there in the first place

Police say some questions have to remain unanswered after this case still has to go to a grand jury.

As of now, the 12-year-old is alive but in critical condition in a Fort Worth hospital. The 8-year-old was treated at Hendrick Medical Center and released. Police are trying to determine if he was hit by a bullet or flying glass. He has been  taken into protective custody by CPS.
