Family of Man Shot By Officers Speaks Out

The Martinez family has been in the news before. In 2007, Patrick Martinez's niece, four-year-old, Janie De La Paz was shot and killed in a drive-by shooting while she slept in her bed leaving the family to ask why.
Patrick says, today all those feelings came flooding back. The family is once again asking why after Miguel Martinez was shot after a a run-in with police.
Patrick also has another question, he says his mother wants answered. He just can't believe his brother, Miguel Martinez would pull a gun on an officer, much less have a gun
The Abilene Police Department says they can not disclose that information at this time because the case has to go to a grand jury. APD went on to say officers are not required to give warning when confronted with deadly force. As you can imagine, deadly force encounters do not always lend themselves to such opportunities.
Patrick did say his brother liked to drink and he was separated from his wife, but to go this far was not like him.
