44-year old Michael Todd Hair was taken into custody and charged with injury to a child, in connection with a traffic accident that happened last year at South 1st and Grape Street in Abilene. Police say Hair failed to stop at a red light.

Today, the mother of eight year old, Tristan Galvan, learned that the man responsible for her son's injuries was arrested.

Heather Duncan says even though the arrest will not help her son recover, she hopes it will stop him from getting back behind the wheel.

On August 12th of last year, Michael Todd Hair ran a red light and hit the car Tristan was in. Tristan was flown to Cook Children's Hospital where Duncan learned he would never be the same. With severe brain damage, Tristan needs around-the-clock care.

She says she thought the whole incident was going to be swept under the rug, but it turns out the case had to go through the long process of getting to this point. Now she says she wants justice.

Tristen will be nine in January and his mom says she is still praying for a miracle in his recovery.

Michael Todd Hair has bonded out of jail on a $15,000 bond.
