Man Shot, Killed following Break-In and Assault

A shooting in East Abilene early Wednesday morning has left a man dead, in a case of apparent self-defense.

34-year-old Ernest Gonzalez is accused of breaking in to his ex-girlfriend's home in the 1000 block of Minda Lane just after 2 a.m. Police say he then assaulted the 35-year-old female victim, while her two children were in the home.

During the assault, the victim retrieved a handgun and shot Gonzalez one time.

Gonzalez was taken to by ambulance to Hendrick Medical Center, where he later died. His body was taken to Fort Worth for an autopsy.

Police say the case will be forwarded to a grand jury for review, but criminal charges against the victim are not anticipated.

Below is the official statement released by Sergeant Lynn Beard of the Abilene Police Department:

Synopsis: On 12-25-12 at 2014 hrs, APD responded to a disturbance call in the 1000 block of Minda Lane. Upon arrival, responding officers contacted a 35-year-old female. She reported her estranged ex-boyfriend, Earnest Gonzales, came to the residence and attempted to gain entry by kicking a side door. Gonzales fled the scene after he discovered Taylor called the police.

On 12-26-12 at 0209 hrs, Gonzales returned to the residence and gained entry to the house by forcing open the front door, causing considerable damage. Gonzales entered the residence and assaulted the female vicitm. Also present in the house at the time of the assault was a 16 year old and a newborn child (both are children of the victim). During the assault, the victim retrieved a .380 handgun (which she was in legal possession of) and fired one shot, striking Gonzales in the left side.

Gonzales left the residence and was located by responding patrol officers in the front yard of the residence. Gonzales was transported by ambulance to Hendrick Medical Center where he succumbed to his wound. Gonzales' body was transported the Tarrant County Medical Examiner's Office in conjunction with an autopsy order issued by J.P. Deatherage.

Counselors from the Regional Victim Crisis Center and advocates from The NOAH project responded to the scene and assisted the victim.

This case will be presented to a Taylor County Grand Jury for review. We do not expect any criminal charges to be filed in this case.

Gladly, she still had the right to own a handgun to protect herself. I am sure she will have her issues to deal with in the taking of a life. Especially one she had loved at one time. But she will have a lot fewer issues to deal with, and they should be easier to cope with than if she had been [censored]. My heart and prayers go out to her for a quick and complete healing. Glad it turned out well for her physically.
