It was 8:14 p.m. on Christmas when Ernest Gonzales went to his girlfriend's home and kicked in the side door. He then left after he found out she had called the police.

Police reports say Gonzales returned to the home after 2 a.m. and assaulted his estranged girlfriend and her 16-year-old daughter. Fearing for their and a newborn's lives, she opened fire killing Gonzales.

Gonzales' sister, Michelle Gonzales, says this sequence of events was planned. She says the fighting was normal behavior for the pair, but her brother did not need to be shot and killed. Michelle says all the girlfriend needed to do was to call the police again.

A check of police records shows officers had visited the home 12 times just this year. Gonzales says this case should have ended with another call to police and she will continue to seek justice her brother.

Police say they do not expect charges to be filed in the case.

KTAB news has tried to contact the victim in this case, but her family says they just want to put this incident behind them. Gonzales' family says Ernest lived in the home with his girlfriend and the newborn baby was his.

It is very easy for someone to say Ms. Taylor should have called the police. I am sure if you would have had the opportunity to do that before being assaulted at 2AM, I am sure she would have. I do not believe it is normal for anyone to live in a domestic violence relationship. This is not normal. So from what I understand some have the belief she should have let him assault her all night if that was what he wanted to do and then call the police. Or maybe she means she should have said hold on, before you put your hands on me and my children let me call the police. Ms. Taylor acted in self defense for her and her daughter. If a man put there hands on my daughter I would do anything to protect my child. That is what a mother is suppose to do. I do know that Ms. Taylor bought and owned this house for some time. She was the owner and I was aware that he had not been wanted there for some time. I know I saw the locksmith there several times the past month. I have known Ms. Taylor and her children for many years, she is a very respectful person with a caring heart. I know Mr. Gonzales did not have a residence. He stayed from place to place because his own family did not want him. This is very sad. I don't want to continue telling the truth. He has passed, God give him peace and rest his soul. I ask to not judge unless you want to speak but speak the truth. I am very sorry for you because he was a son and a brother to someone. Ms. Taylor lived in this house with her children. Mr. Gonzales was seen during visits, but this was not his residence. I can tell you Ms. Taylor did shoot him with the intention to kill, this is not the person she is. I am praying for all the families involved.

Sounds like he was a real pillar of the community, he was obviously terrified of the police... From the original article: "he has past convictions for aggravated assault, attempted murder and various drug charges. He was released from jail in August after arrests on burglary and drug charges."
