Kevin Scott Kellerby was convicted of continuous sexual asset of a child and is now serving a 55 year prison sentence, and will have to pay a $10,000 fine after his sentence was handed down in January.
Now, the mother of Kellerby's victim is suing kellerby and his parents in a civil law suit.
The suit claims that Kellerby sexually assaulted the victim behind closed doors at Kellerby's parents' home.
According to court documents, the victim told Kellerby's mother that she was being assaulted.
The suit claims Kellerby's mother instituted a "no closed door policy," in her home, but the abuse continued. The suit says the abuse continued, even while Kellerby's parents were present in the home.
So, the victim's mother is suing for her daughter's medical bills, past and future, and also for her daughter's mental anguish. The mother is also suing for her own past and future mental anguish because she claims she blames herself for the abuse.
No trial date has been set.
Employees at the courthouse cannot remember a situtation where a conviction in a criminal trial was followed by a civil lawsuit demanding monetary damages.
