Dyess sent the following information regarding what took place at the arraignment on Tuesday:
The military judge reviewed appellate exhibits previously submitted by defense and trial counsels, to include motions for a change of venue and a request for continuance. The defense deferred making its motion to change venue until a later date. The defense made a motion for continuance, which the military judge granted. The next case event is the 802 conference on 25 March, at which time the parties will inform the military judge of their respective statuses. The military judge will consider the information provided at the conference and set the next court event, which may include a trial date. For more on the Klapheke case and the case of Christopher Perez, click here.
An "802" refers to Rule of Courts-Martial 802 ("Conferences"). The purpose of such conference is to inform the military judge of anticipated issues and to expeditiously resolve matters on which the parties can agree, not to litigate or decide contested issues. The conference is conducted outside the courtroom.
SrA Perez elected to defer submitting his plea to the court until rulings on motions are made. SrA Perez, by and through his counsel, will have an opportunity to bring additional motions at any time prior to entering his pleas. If brought, the military judge may need to rule on those motions before SrA Perez enters his pleas.
